Affiliate Addendum to Terms of Service

This Affiliate Addendum (the “Addendum”) is an integral part of the Terms of Service (“TOS”) governing the use of tap47poster.com (“Website”). By enrolling in and participating in the Affiliate Program (the “Program”), you (“Affiliate”) agree to comply with this Addendum, in addition to the general TOS.

1. Affiliate Enrollment

1.1 Eligibility: To join the Program, you must apply through the designated application process and meet the eligibility criteria outlined by the Website. Acceptance is at the sole discretion of tap47poster.com.

1.2 Approval Process: Upon application, we will review your website, social media presence, or other channels to determine suitability. We reserve the right to accept or reject any application without providing a reason.

2. Affiliate Obligations

2.1 Promotion Guidelines: Affiliates must promote the Website in a lawful, ethical, and professional manner. Affiliates are prohibited from:

• Misrepresenting the Website or its products.

• Engaging in deceptive marketing practices.

• Using spam or unsolicited messages to promote their affiliate links.

2.2 Compliance with Laws: Affiliates must comply with all applicable laws and regulations, including but not limited to:

• Advertising guidelines (e.g., FTC Endorsement Guidelines in the U.S.).

• Privacy laws and anti-spam regulations.

2.3 Prohibited Activities:

• Affiliates may not use paid advertising (e.g., PPC, Google Ads) targeting the Website’s branded terms.

• Affiliates may not impersonate the Website in any form, including creating false social media profiles or using unauthorized domains resembling the Website.

• Affiliates are prohibited from using affiliate links on coupon sites, unless explicitly authorized.

3. Affiliate Links and Tracking

3.1 Affiliate Links: Affiliates will receive a unique tracking link (“Affiliate Link”) to promote the Website. This link must be used to ensure proper tracking of referred customers.

3.2 Cookie Duration: Referred customers will be tracked using cookies. The default cookie duration is 360 days from the initial click, unless specified otherwise.

3.3 Attribution: Referrals will be attributed to the Affiliate whose Affiliate Link was last clicked prior to the customer’s purchase.

4. Commissions and Payments

4.1 Commission Structure: Affiliates will earn a commission based on:

• A percentage of the referred customer’s purchase amount (excluding taxes, shipping, and refunds).

• The commission percentage or structure defined at the time of acceptance into the Program.

4.2 Payment Terms:

• Commissions are paid monthly via specified in the Affiliate profile.

• Minimum payout threshold: Affiliates must earn at least $50 before payments are issued.

4.3 Refunds and Chargebacks: Commissions will not be paid on orders that are canceled, refunded, or charged back. If commissions have already been paid, they will be deducted from future payments.

4.4 Taxes: Affiliates are responsible for reporting and paying any taxes applicable to their earnings.

5. Program Termination

5.1 Voluntary Termination: Affiliates may terminate their participation in the Program by providing written notice.

5.2 Termination by Website: We reserve the right to terminate any Affiliate’s participation immediately and without prior notice for:

• Violation of this Addendum or the TOS.

• Fraudulent or unethical behavior.

• Any activity deemed harmful to the Website’s reputation or operations.

5.3 Effect of Termination:

• Upon termination, the Affiliate’s rights to use Affiliate Links will cease.

• Outstanding commissions above the payout threshold will be paid, provided the Affiliate has not violated the Addendum.

6. Intellectual Property

6.1 License to Use Marketing Materials: Affiliates are granted a non-exclusive, revocable license to use approved marketing materials, including logos, banners, and product images, solely for promoting the Website.

6.2 Restrictions:

• Affiliates may not modify the Website’s trademarks or use them in a misleading manner.

• Unauthorized use of intellectual property is grounds for immediate termination.

7. Limitation of Liability

7.1 The Website is not liable for indirect, special, or consequential damages (e.g., lost revenue) arising from participation in the Program.

7.2 The Website’s total liability under this Addendum is limited to the total commissions earned by the Affiliate in the preceding 3 months.

8. Amendments

We reserve the right to amend this Addendum at any time. Affiliates will be notified of significant changes via email or through the Affiliate dashboard. Continued participation in the Program after an amendment constitutes acceptance of the revised terms.

9. Governing Law

This Addendum is governed by the laws of the state of Florida, without regard to its conflict of law principles.
